Terms of Service

1. Acceptance of Terms

By accessing or using GijiSpot services, you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization.

2. Service Description

GijiSpot provides AI-powered surveillance analytics through edge devices installed at your premises and a cloud-based management dashboard. Our team handles device installation, configuration, and ongoing maintenance.

3. Subscriptions & Billing

• Subscriptions are billed monthly via Stripe
• AI features are billed per-camera at the listed monthly rate
• You may cancel your subscription at any time; service continues until the end of the billing period
• Pricing is subject to change with 30 days notice
• Edge device hardware remains the property of GijiTech Software

4. Your Responsibilities (Data Controller)

As the data controller for surveillance footage captured on your premises, you agree to:

• Post visible surveillance notices at every entry to a monitored area, identifying the operator and the purpose of the surveillance. This is required under Canada PIPEDA Principle 4.3 and most provincial workplace privacy regimes (and equivalent laws in other jurisdictions).
• Obtain explicit consent from individuals where required by your jurisdiction, particularly before activating biometric features (facial recognition).
• Configure a retention period appropriate to your purpose; under PIPEDA, personal information may not be retained longer than necessary.
• Respond to data subject access, correction, and deletion requests for footage and analytics derived from your premises. We will assist on request.
• Ensure camera placement complies with local laws (workplace privacy, employee surveillance, public-space recording restrictions).
• Provide adequate power and network connectivity for edge devices.
• Protect your account credentials and API keys.
• Do not reverse-engineer, modify, or tamper with edge devices.

5. Data Ownership and Roles

You retain ownership of all surveillance data generated at your premises. Under PIPEDA you are the data controller for that data; GijiTech is the data processor, acting on your instructions and under contract. We do not sell, share, or use your surveillance data for any purpose other than providing the service to you, and we do not train cross-tenant models on it.

5a. Biometric Data and Prohibited Uses

If you activate facial recognition you acknowledge that face embeddings are biometric data regulated under PIPEDA, GDPR Article 9, CCPA, BIPA, and similar laws. You agree:

• Not to use facial recognition for purposes outside the security or operations purpose disclosed in your surveillance notice.
• Not to share, sell, or transfer face embeddings to third parties.
• Not to use GijiSpot to track or profile protected classes, political activity, religious affiliation, or union activity.
• Not to use the platform for unlawful surveillance, including covert workplace monitoring prohibited by local law.

Violation of these conditions is grounds for immediate termination under §8 and indemnifies GijiTech for any resulting claims.

6. Service Level

We strive for 99.9% cloud platform uptime. Edge devices operate independently and continue functioning during cloud outages, queuing events for later synchronization. We do not guarantee specific AI detection accuracy rates.

7. Limitation of Liability

GijiSpot is a monitoring and analytics tool, not a replacement for professional security services. We are not liable for incidents that occur despite or due to system alerts, detection failures, or service interruptions.

8. Termination

Either party may terminate this agreement at any time. Upon termination, our team will schedule removal of edge devices from your premises. Access to dashboard data will be available for 30 days after termination.
